The ministerial exassor Koldo García has asked the magistrate of the 'Koldo Case' in the Supreme Court that agrees the “precautionary and immediate judicial kidnapping” of the audios of their telephone terminals who are not directly related to the procedure by considering that the dissemination of voice notes related to their “most intimate sphere constitutes a very serious intrusion into their fundamental right to personal privacy”.
In a letter to which Europa Press has had access, the defense of Koldo García refers to the voice messages contained in the three phones and a recorder that were seized in the registration of his home. These devices were overturned last week, revealing more than 22,000 messages of all kinds.
It is specifically the recordings described in the order by which the magistrate sent to provisional prison the former secretary of Organization of the PSOE Santos Cerdán on June 30 and collected in the report of the Central Operational Unit (UCO) of the Civil Guard that pointed to him as an alleged head of the Amaño plot of Public Works.
The representation of the former minister José Luis Ábalos recalls that “it has been facilitated to the parts personally in the present case that have requested the full content of said material overturned.” “Part of this material, including strictly private and intimate recordings, completely alien to the object of the judicial investigation, have been subject to massive filtration and its consequent diffusion through various media,” he laments.
In wire, his lawyer says that “this situation has led to the public exhibition of personal and family conversations, including audios of its most intimate sphere, such as the time when it interacts with its youngest daughter, which constitutes a very serious interference in its fundamental right to personal and family intimacy, as well as in its closest environment, especially that of minors.”
The “reality” of audio
His defense also regrets that audios have been published in which it is implied that Koldo García was “perpetrator of gender violence” towards women. In a voice note contained in the summary, to which Europa Press has had access, a woman says-it is not specified to whom —: “You have hit me. Above the child, you hit the child
I can't stand it. ”
In this context, “the reality of this audio”, according to its representation, is that Koldo García worked for several years for a company developing, “among other work, the security person in charge, with the position of Inspector, coordinating escorts and security guards for women victims of gender violence.”

In line, his defense ensures that Koldo García's working life can contribute to prove this extreme or, if he considers the instructor, “propose as witnesses women victims of gender violence who at the time went” to him “in search of help for having suffered such violence.”
