The Prosecutor's Office has asked the Provincial Court of Madrid to prevent the Central Operational Unit (UCO) of the Civil Guard from analyzing the emails of the official presidency account of the government's president's wife, Begoña Gómez, since July 2018-when the appointment of his advisor was agreed-until now.
The Public Ministry has presented an appeal, to which Europa Press has had access, against the providence issued by Judge Juan Carlos Peinado on September 3 in which he ordered said diligence to the agents of the Armed Institute by considering that it is “absolutely excessive.”
For the prosecutor, the measure “undoubtedly” affects “the privacy and secret of communications, and ultimately to the right to the virtual environment of the affected person.” “That is, fundamentally protected fundamental rights are affected,” he says, and affects that the diligence should be dictated through a car and not a providence.
At this point, in addition, he remembers that the Madrid hearing itself has already notified the same occasions to the combed judge that certain decisions should be issued through car.
However, the Prosecutor's Office argues that the decision of the instructor “suffers from the most elementary motivation” and emphasizes that to agree on a diligence of this type “it is necessary” to explain why it is adopted and for what purpose.
In this case, it considers that “the absence of analysis of all principles is evident, since there is no analysis or specialty, suitability, or exceptionality, or need.” And asks: “Is it proportional attending to the principles and criteria exposed to collect and analyze all emails sent and received? All? Are all emails related to the crime investigated? (…) What are we looking for with the adoption of this measure.”
The appeal of the Prosecutor's Office joins the one presented by the defense of Begoña Gómez, in charge of the former socialist minister Antonio Camacho, who also asked the Madrid audience to stop the analysis of the mails.
